Judge Muir said that, over that period, she became "increasingly confused and forgetful". On the balance of probabilities, the judge ruled the "gift" came from "significant and undue influence from [Martha's] trusted nephew". When it came to the thousands withdrawn from ATMs, Judge Muir said Simon did not keep receipts. He ordered Simon to repay that sum with interest. He was ordered to repay only $12,000 of the legal fees as that sum was found to be for his benefit.
