Mohamed Ali Ahmed Elmushraty, better known as Lilu King, would likely be tortured or even killed if he were to be extradited to Libya, his lawyers said on Tuesday. It also emerged that Libya is planning to seek his extradition to face charges there. In a note filed by defence lawyers Franco Debono, Marion Camilleri and Francesca Zarb, the lawyers highlighted that the accused had been granted refugee status in Malta due to “persecution” in Libya. The defence highlighted that Libya is an unstable country that has been in a civil war since 2011. “If extradition were to go through, not only would Elmushraty not be guaranteed a fair trial but there existed a ‘real possibility’ that he would tortured or even killed,” the lawyers said in their note.

At a time when the fate of the elections in Libya is shrouded in uncertainty, UN envoy Abdoulaye Bathily stressed that many disputes plague the process. Bathily explained that the electoral process in Libya still faces many points of contention among Libyans, noting that these points require reaching a political agreement between the main political parties. He indicated that without reaching a complete consensus, the electoral process will face a dead end like the 2021 elections, and this will lead to a new crisis. The Security Council called for more pressure on the political parties concerned in order to overcome these differences in order to lead the country to elections, and asked the Libyan leaders to work to uphold the interests of the Libyans. It is noteworthy that the UN had confirmed that the political process in Libya had reached a sensitive stage.

A court has been asked to postpone hearings in ongoing libel cases filed by disgraced former prime minister Joseph Muscat and his wife against Daphne Caruana Galizia indefinitely, in view of a constitutional case filed by her heirs last week. “If someone is filing a case after an inquiry established that she has been murdered, how can I defend her? The lawyer pointed to the system adopted by the UK, where if either plaintiff or the defendant died before the conclusion of the libel case, the proceedings were declared extinct. “Under Maltese law this option does not exist, so I needed to file a constitutional case explaining that it is impossible for me to make a defence. Zammit Maempel argued that he could not see any other option for the Court of Magistrates but to follow the decision of the Constitutional court and put this case on hold until a definitive decision on the constitutional issue.

NEW YORK CITY: Successful elections in Libya will require not only the establishment of a proper legal framework within which they can take place, but also a political agreement that ensures buy-in to the process from all stakeholders, the UN warned on Monday. Presidential and parliamentary elections were supposed to be held in December 2021 but did not take place, amid persistent differences of opinion among political factions on a number of key issues, including who should be allowed to stand. It also calls for the establishment of an interim, unified government tasked with organizing and conducting the elections. “The eligibility criteria for presidential elections, the linkage between presidential and parliamentary elections, and the issue of forming a new unified government are highly contentious and require, first and foremost, a political agreement among the major stakeholders and key constituencies across the Libyan political spectrum,” said Bathily. Short of such an agreement, the laws will not only remain impossible to implement, he added, they could also trigger a fresh crisis.

In the ensuing debate, Council members urged officials to advance the country’s political process and give the Libyan people the political and economic stability they deserve. Yet the mixed reception to their announcement shows the need for broader political agreement between Libyan power-holders. Successful elections require not only a legal framework but also a political agreement that guarantees the inclusion of all stakeholders. VANESSA FRAZIER ( Malta ) expressed support for political consensus and the legal framework needed to advance a Libyan-led and Libyan-owned political process. To maintain gains achieved by Libya, measures adopted by the Council must not impede the Libyan forces’ efforts to address security threats.
