Some are also justifiably concerned about the potential disclosure of the personal data of millions of MySejahtera users between private entities. In 2010, Malaysia passed the Personal Data Protection Act. Lesson #2: Do not disclose personal data of your customers/users to third parties without their consentRegardless of who legally owns the personal data, the more important question is this: Besides the government and KPISoft, who else had access to our personal data in MySejahtera? However, if it did have access and MySejahtera users had not consented to such access, it would be a breach of the PDPA. In short, tread carefully and seek expert advice, if necessary, whenever personal data is at stake.

A milestone in 1985 was the founding of the Institutional Shareholder Services and the Council of Institutional Investors in the US. In the 1990s, labour union pension funds replaced public pension funds as the main shareholder activism player, and mutual funds also jumped on the activism bandwagon. In Malaysia, minority shareholder activism is spearheaded by the Minority Shareholders Watch Group (MSWG). Additionally, Bursa may want to revamp the way the voting outcomes at shareholder meetings are announced by showing separately shares voted under the public float category, as the number of shares held by minority shareholders that voted at the AGM is a good indicator of minority shareholder activism. A hybrid shareholder meeting, with video streaming and availability of the minutes online, may further bolster the shareholder activism momentum.

Attorney General (AG) Tan Sri Idrus Harun told theedgemarkets.com this on Saturday when asked to comment on Ng's case in Malaysia following his conviction in the US on Friday. In Malaysia, Ng is facing charges under the Capital Market Services Act 2007 (CMSA). “We (Malaysia) will wait for the process of sentencing after which Roger [Ng] has the right to appeal against conviction and sentence,” Idrus said briefly. Although Ng is charged with abetment with Goldman Sachs, the charge against the US financial institution was dropped in September 2020 after it agreed to a US$2.5 billion financial settlement with Malaysia. Although the forfeiture was dismissed by the High Court last November, the prosecution is appealing the matter to the Court of Appeal.

Some countries were already in a governance crisis before Covid, and I would place Malaysia among them. In some ways, Malaysian politics survives on maintaining an unending sense of crisis, in one way or another. Whichever the case, the Covid crisis did come at exactly the same time that the country was already in a new self-generated political crisis. The Malaysian public believes that the way their country is organised is self-damaging, lackadaisical and irretrievably held captive by political games. Train and employ technocrats, enhance technocratic procedures in governance again, and balance them against the position of bureaucrats and politicians.
