As Expected, SCOTUS Rules against Trump on Tariffs


The 6-3 opinion ruling that Trump’s tariffs are unlawful is here. “Emergency powers,” after all, “tend to kindle emergencies.” Youngstown Sheet & Tube Co. v. Sawyer, 343 U. S. 579, 650 (1952) (Jackson, J., concurring). Trump was meeting with Governors when the ruling came down so we have to wait for whatever tantrum he throws in response. So he asked for the headache he’s about to have, paying all the tariffs back. Update: WRT Trump’s vow to simply reimpose all these tariffs, this footnote from Roberts is probably pertinent.
