This promises that for many decades to come, if this project becomes a legal reality, the same legal logic will govern the criminal liability of generals and soldiers of organized crime. Thus, the generals of the criminal organization in Article 491 are sentenced to 3 to 8 years in prison, while the soldiers of this formation are sentenced to 2 to 6 years in prison. This confusion of criminal degrees has nothing in common with articles 491 - 494 of the new draft Criminal Code. The President of the Republic remains to decree a presidential veto rejection, through which he will justify to the Minister of Justice, the Council of Ministers and the Assembly that soldiers cannot be promoted with the criminal liability of generals and that generals cannot be treated as soldiers.
