While the high court collegium will deal with complaints about candidates under consideration, the Supreme Court collegium will deal with complaints once it receives the recommendations of the high court. Sources in the Supreme Court told The Indian Express that CJI Thakur will hold consultations with four of his senior-most brother-judges and take a fresh view on the draft MoP. The government is also sticking to its stand in the draft MoP that chief ministers should have a well-defined role in the appointment process. The government has also reiterated that there should be clear-cut, transparent criteria to deal with making additional judges of the high court — appointed for a period of two years – permanent, or even while re-appointing them after completion of their terms. It has cited paragraph 7 of the December 16, 2015 judgment of the Supreme Court in the National Judicial Appointments Commission (NJAC) matter to stress on the need to have “supporting measures” so that “candidates can be screened and evaluated”.
