When Carter Bank and the Justices appeared before Martinsville Circuit Court Judge Carter Greer on Dec. 11, attorneys for Carter Bank presented Greer with confessed judgments in-hand that included personal guarantees from West Virginia Gov. Companies owned by Justice embroiled in the financial dispute include the Greenbrier Hotel, Greenbrier Golf and Tennis Club, Oakhurst Club, Greenbrier Sporting Club, Player Club, Justice Low Seam Mining, Twin Fir Estates and Wilcox Industries, James C. Justice Companies, Justice Family Group, and Greenbrier Medical Institute. The complaint accuses Carter Bank of violating the Bank Holding Company Act, breach of contract, breach of fiduciary duty, and tortious interference with business relations. He is also considered to be a leading Republican candidate in West Virginia for the U.S. Senate seat being vacated by the incumbent Democrat, Joe Manchin.
