A legal action has been taken aimed at preventing gardaí from interviewing a 14-year-old intellectually disabled boy in connection with an allegation he had sexual contact with a 12-year-old child. An injunction restraining a planned interview of the boy on a date this week was granted by the High Court earlier this week pending further order. His disabilities mean it would not be possible to get any comprehensive account from him of the alleged incident, the social worker said in an affidavit. The harm that will be caused to the boy by the interview process will be “disproportionate” to any value that might be gleaned from the interview, the social worker said. While concerns about the impact of interview had been raised with gardaí, it appeared that the intention was to proceed, the social worker said.
