Moreover, these bills don’t protect pregnant women and people from wrongful death claims based on behaviour during pregnancy that leads to fetal death. The legislation also overreacts, somewhat ironically, by seemingly precluding any remedy for prospective parents who lose reproductive options based on an IVF clinic’s wrongful acts. (The bills from both Alabama’s house of representatives and senate do not allow clinics to be sued for wrongful acts. Finally, both the Alabama and federal legislative fixes reflect the view that IVF and abortion are entirely separate.
