Jackson Kones Nangiro was accused that on January 3, 2016 at Vumilia ‘A’ village in Eldoret West District within Uasin Gishu County unlawfully and intentionally defiled the minor and infected her with HIV virus. BEYOND REASONABLE DOUBTHowever, Eldoret Principal Magistrate Charles Obulutsa on Monday ruled that the prosecutor had proved to court beyond reasonable doubt that the accused committed the offence. “The prosecution has proven beyond reasonable doubt that the accused defiled the girl. But the magistrate reminded the accused that his action has damaged a young girl’s future by infecting her with HIV virus and that he does not deserve mercy.
