Prosecution counsel Julian Goode told the court that on June 16 this year the 37-year-old entered Royton Phones on Oldham Road in Royton and began enquiring about buying a phone. The shopkeeper ran out and caught up with Spencer, before grabbing him and shouting at him to give back the phone. By this point, Spencer was with another man and the pair both began pushing and kicking out at the shopkeeper. Mr Goode told the court Spencer had a "lengthy" criminal record, including numerous offences of shoplifting and assault. She sentenced Spencer, of Horsehedge Road, Oldham, to 15 weeks in prison, half of which will be served in prison and the other half on licence.
