Judgment has been reserved in an application by the South African Human Rights Commission to hold Msunduzi Municipality accountable over the New England Road landfill site. The case was argued in the Pietermaritzburg High Court on Friday before Judge Rishi Seegobin. The commission wants the court to find that the municipality breached its duty in its management of the landfill site by violating the waste management licence, the national Environmental Management Waste Act, the National Water Act, a section of the Constitution and international law. It is also asking the court to direct the municipality to file an action plan with the court on how the municipality is going to address all the non-compliances.
