Robert Mueller has delivered his report, but there’s a defect in how his investigation was funded. Unless Congress fixes it, any prosecution by Mr. Mueller’s office may be invalid. Instead of asking Congress to appropriate money for Mr. Mueller’s investigation, the Justice Department funded it out of an unlimited account established in 1987 to pay “independent counsels.” The problem is that Mr. Mueller is a special counsel, not an independent counsel.
