Safeguarding judicial independence


BERSIH 2.0 and the Bar Council organised a webinar last Monday on judicial independence. First, traditional constitutional theory on judicial independence emphasises independence from the Executive. However, threats to judicial independence come as much from private centres of power as from the executive organ of the state. Our concept of judicial independence must take note of all threats to judicial independence no matter where they emanate from. Second, security of tenure, much more than a proper system of appointment, is important for preserving judicial independence.
