The Case For This Licensing Scheme Is Ridiculous -- But The Eighth Circuit Just Swallowed It


In a Missouri case, two of them challenged the state’s licensing rules on constitutional grounds. The plaintiffs, Ndioba Niang and Tameka Stigers, argued that the Board’s licensing rules violated their rights under the 14th Amendment. Not willing to give in to the state’s regulators, the plaintiffs appealed to the Eighth Circuit, which handles cases arising in Missouri. But in Niang v. Carroll, a three-judge panel in the Eighth Circuit decided in favor of the Board. In upholding the state, the Eighth Circuit approved of a legal test that makes it nearly impossible for aggrieved people to overcome such licensing rules.
