Supreme Court Justice Brett M. Kavanaugh took part in the net neutrality case as a judge in a lower court and recused himself from it now that he's on the high court. Circuit upheld the regulations, prompting industry groups to escalate the case to the Supreme Court. The GOP-led effort to repeal the FCC’s net neutrality rules set off a separate round of litigation, as tech companies and consumer groups sued to block the deregulation. Circuit, is quickly becoming the center of the legal battle over net neutrality now, with the Supreme Court deciding not to hear its net neutrality case. Internet providers who had petitioned the Supreme Court said they support an open Internet.
