Rose Mulwa, who had lodged a case in court, also made a complaint against Justice Mutava through the judiciary ombudsperson, Kennedy Bidali. LSK sent a petition to the JSC, and the commission constituted a subcommittee headed by Justice Smokin Wanjala to establish whether judge Mutava had behaved irregularly. In 2013, High Court judge Joseph Mutava acquitted Kamlesh Pattni of all charges related to the Goldenberg scandal, saying the businessman would not get a fair trial because the case had dragged on for two decades.
