At least, that’s the crux of what Solicitor General John Sauer proposed Monday as he urged the Supreme Court to let President Donald Trump fire heads of independent agencies. Congress, historically, grants power to these agencies because there is an understanding that no single person controls them. “And if you take away half of this bargain, you end up with just massive, uncontrolled, unchecked power in the hands of the president. and it’s really hard to affect both sides of this bargain,” Kagan said. This is precisely why Congress didn’t want to make certain agencies “directly accountable” to the president; they saw the “significant danger” in it, she said.
