A week before President Trump announced that the United States was pulling out of the Paris climate agreement, he got an important piece of mail on the subject. Twenty-two Republican Senators sent the President a signed letter on May 25th "strongly encourag[ing]" him "to make a clean break from the Paris Agreement." If President Trump wants to revoke the Clean Power Plan - as he has pledged - environmental groups will certainly try to argue that he can’t do so. But the fact that the U.S. has now pulled out of the Paris climate agreement will have no impact on the veracity of their case. The legal challenges to the Clean Power Plan have mainly focused on part 1 of this test.
