The Judge said his surety must produce a Certificate of Occupancy of a property and not Right of Occupancy. He was however granted bail with conditions including a reasonable surety with landed property within the Federal Capital Territory in Abuja while such property must have a C of O. The defendant and his surety must deposit two recent passport photographs to the Court while Umejidike should submit his international passport. He was also given a bail bond of N2 million and one surety in the like sum. He pleaded that Justice Abubakar should vary the C of O with Right of Occupancy, a move opposed by prosecution lawyer, Celestine Odo.
