HC order on writ challenging oath-taking of MPs Thursday


The bench of Justice Moyeenul Islam Chowdhury and Justice Md Ashraful Kamal on Wednesday fixed the date after hearing the petition, reports UNB. Supreme Court lawyer Advocate Taherul Islam Tawhid had filed the petition on Monday seeking the court’s directives to revoke the oath of the newly-elected MPs, saying their swearing-in took place illegally before the expiry of the 10th parliament. According to the writ, the speaker administered oath to the new MPs on January 3 following publication of a gazette — which is the violation of Section 123(3) of the constitution as they were sworn-in before the expiry of the 10th parliament. The five-year tenure of the 10th parliament is supposed to end on January 28. The speaker, the chief election commissioner and the cabinet secretary were made respondents to the writ.
