The changes that can be implemented by appointment or executive order warrant some business thinking about how they manage employees. New appointees to the National Labor Relations Board will probably resume Obama era “joint employer” rules that affect corporate contractors and franchisee. Reverting to the Obama era rule will make union organizing a little easier, but not overwhelmingly so. Businesses contracting with the Federal government will find Obama era rules in which their past labor law violations will be considered when new contracts are awarded. In addition, the Biden administration will only award contracts to companies paying a minimum of $15 per hour.
